This California Consumer Privacy Policy (as updated from time-to-time, this “CA Privacy Policy”) is to explain BondiBoost’s data collection and privacy practices.  This CA Privacy Policy supplements our general privacy statement and applies only to California residents.

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with certain privacy rights related to the personal information BondiBoost (“BondiBoost” “we”, “us”, or “our”) collects about you.  Please see below to learn more about your rights under the CCPA and to learn more about your rights and our practices.

Please read this entire Policy carefully to understand our practices regarding your personal information. The following points summarize some of the important details about the CCPA discussed below:

  • a California consumer has the right to request that we disclose what personal information we collect, use, disclose, and sell.
  • a California consumer also has the right to request that we delete the personal information we have collected from the consumer.
  • a California consumer has the right to opt-out of the sale of their personal information. 
  • a California consumer has the right to not receive discriminatory treatment by us for the exercise of their privacy rights under the CCPA.
  1. What Is Personal Information?

The CCPA provides personal information rights to California residents. The CCPA defines personal information as information that “identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular” California consumer or household. Personal information does not include publicly available information or consumer information that is deidentified or aggregate consumer information.

  1. What Personal Information Do We Collect About You?

We collect or generate personal information about you in a number of ways depending on the product or service and the relationship we have with you.  For example:

  • We collect your first and last name, email address, and a password when you create an account with us or make a purchase.
  • We collect your billing and shipping address and phone number if you make a purchase.
  • If you enter a search term on our site, that term may be associated with your account or another identifier.
  • We collect your email address if you provide it to us in connection with subscriptions, discounts and/or promotional offerings.
  • If you write a review, we may associate the review and your name with your account or another identifier.
  • If you contact us via email at any of our BondiBoost email addresses (using the BondiBoost.com domain) or write to use at our physical mailing address, we may collect and retain any personal information you provide in that email and associate it with your account or another identifier.
  • We keep track of the purchases you make and the products you are interested in.
  • If you purchase a product, we receive information from third-party payment processors, but we do not collect or store payment card information unless you authorize us to.
  • Our servers automatically collect usage information about your use of our website, including the webpages visited, number of log-ins, data displayed or clicked on, actions taken, your language preference, and other usage information.
  • We collect information from the device and application you use to access our Services. Device data mainly means your IP address, operating system version, device type, device ID/MAC address, system and performance information, and browser type. If you are on a mobile device we also collect the UUID for that device.
  • We use first party and third party cookies and tracking services that employ cookies and page tags (also known as web beacons) to collect usage information.
  • We keep log files that contain data about the nature of your access to our servers, including originating IP addresses, internet service providers, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system versions, device type and timestamps.
  • We may collect information from unaffiliated third parties so that we can better understand you and provide you with information, products and offers that may interest you.

  1. How Do We Use Your Personal Information?

We use your personal information for the following business purposes:

  • Billing and Shipping our products to you;
  • Providing our website and related services (for example, account servicing and maintenance, customer service, advertising and marketing, analytics, and communication about our services);
  • For our operational purposes, and the operational purposes of our service providers and integration partners;
  • Improving our existing products and services and developing new ones (e.g., by conducting research to develop new products or features);
  • Detecting, protecting against, and prosecuting security incidents and fraudulent or illegal activity;

  • Other uses that advance our commercial or economic interests, such as advertising and communicating with you about relevant offers from third party partners;
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred; and

We may also use your personal information for any other purpose that we disclose at the time you provide, or when we collect, your information and other purposes permitted by applicable law. We may also use data that we collect on an aggregate or anonymous basis for various business purposes, where permissible under applicable laws and regulations.

  • Facebook/Instagram, one of our service providers, who may also use cookies, web beacons, and similar technologies to collect or receive information from our website and use that information to provide measurement services and target ads.
  1. Do We Sell Personal Information?

California law requires that we describe certain disclosures of personal information where we receive valuable consideration. California law treats such disclosures as “sales” even if no money is exchanged.

We do not sell information to third parties as defined under California law.

  1. What Are My CCPA Rights to Know About My Personal Information?

You have the right to know certain information about our collection, use, and disclosure of your personal information for the 12 months preceding the date of your request. You also have the right to request that we provide you with specific pieces of your personal information. These rights are subject to certain exceptions.

Upon receipt of your request, and after we verify your identity, we may provide you with information about the following:

  • The categories of personal information we collected about you.
  • The categories of sources of the personal information we collected about you.
  • Our business or commercial purpose for collecting the personal information.
  • The categories of personal information we disclosed about you to a service provider.
  • The specific pieces of personal information we collected about you (data portability).

If responding to all or part of your request would conflict with federal or state law, or your personal information is subject to an exemption under the CCPA, we will inform you of that fact. We will respond to the portion of your request that is not in conflict with applicable laws or exempt under the CCPA.

  1. What are My CCPA Rights to Have my Personal Information Deleted?

You have the right to request that we delete personal information we have collected from you, subject to certain exceptions and exemptions. Absent an exception or exemption, upon receipt of your request, and after we verify your identity, we will delete and will request that our service providers delete your personal information.

  1. How Do I Exercise My CCPA Rights?

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. Agents must submit proof that they have been authorized by the consumer to act on their behalf. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We verify requests by sending a confirmation email to the requestor and by matching the identifying information provided by the consumer to the personal information already maintained by us. We cannot respond to your request or provide you with personal information if we cannot: (i) verify your identity or authority to make the request; and (ii) confirm the personal information relates to you. If we are unable to verify the identity of a requestor we will not provide any information.

You may only make a verifiable request for access or data portability twice within a 12-month period. California residents may exercise their California privacy rights by submitting your request here.   1. What Are My CCPA Non-Discrimination Rights?

We will not discriminate against you for exercising any of your CCPA rights, which means we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
